Yes, I am serious. Sirius failed to deliver the show in a manner that perpetuated listeners. They breached the reasonable expectations of the show. When confronted with their obvious shortcomings and failure to deliver,  they bailed, they left AB hanging and the listeners hanging.

IMO and in my experience, Sirius could sue AB if he went ahead and did his show. In order to get monetary compensation or to cause AB to cease and desist, Sirius would have to show damages. They have no show that competes with DM, hence no damages and no cease and desist. They brought upon themselves their own damages. I, like a lot of others, cancelled Sirius.

That's impossible to say without seeing their contract.  However, Art Bell has already stated on this thread that he didn't believe SXM is in breach.

This correlates to my earlier point:  by Sirius reps saying to customers that Art might be returning, they keep a smidgeon of hope alive out there that Art just might, as well as spreading false information.  It is very, very irresponsible, at the very least.

I agree the devil is in the details of the actual contract. I am speaking generally and addressing "reasonable expectations". If the contract says Sirius can't guarantee streaming live and Art signed that, then Sirius wins the legal battle but not the moral battle, IMO.
If I had signed up expecting to be able to stream in real time, I would say that SiriusXM was in breach of MY contract with them because of my expectations. I have streamed C2C for years without trouble so why would I not expect Sirius to be at least as good?

I have already trotted out my Commission Theory:  they may get a bonus if they keep someone signed up, and if that person desperately needs the extra money they may well lie to keep that person on (by that person having it suggested to them that Art Bell may well be back soon).

Sirius likely also has calculated how much it costs to acquire each subscriber (the credit card companies were paying an average of $150 at one point).  And they've calculated how much money Art has cost them over this little fiasco.  I'm sure they've calculated how much he's already cost them, how much he'd make them if he came back, and decided the numbers make it not worth it.

Agree with that.  My new best case scenario is that Art pays them back for the money they lost on him, they in turn let him out of his NC clause.  Win-win.  Sirius hasn't lost out, and the fans get to listen to Art again if he can figure out how to have enough bandwidth to keep his site from crashing when oodles of Art Bell Fans are live streaming his show.

First of all, I spoke from my experience and IMO. Secondly, even if I am right, Sirius may not agree or would be willing to drag this through the courts for what purpose, I don't know other than the fact that they can.

Art has lawyers who will advise him. In the mean time, I will be watching for more information. Based upon what I have heard so far, and I haven't heard Sirius's side, it would be in the best interest of Sirius to just drop it.
