If Art WAS let out of his contract, it would be interesting to see how large the caller pool on the web stream is. It seems to me that, though free, less people would be exposed than on Sirius (regardless of streaming issues). Certainly it'd be more of a hassle to tune in for those truckers going 70 mph down the highway than it is just hitting a preset button on their satellite receivers.

Not reading into anything.  Simply pointing out if SXM is slow rolling Art (by ignoring him) as he claims, he can bring matters to a head very quickly.  He has the technology in place, and believes he's right.  Go for it, make them communicate in court.  What's the worst that can happen?  He's off the air after one show? He's outta business for two years?  That's where were are now.  To me this is a "put up or shut up" moment for both parties.

I'm still waiting for Scarlett Johansson to get back to me with my offer to wash her car. It's a win-win. I get to suggestively wash her car and she gets a clean car for free.

Bad advice.  Non-competes are enforceable in NY and NV, and Art would be subject to Sirius' injunctive relief and monetary judgements, since there aren't any particular legal defenses he could use.  Try again.

Depends on the non-compete.  They are unenforceable under most circumstances.  But, that doesn't matter.  Art has made it clear that he plans to honor it.

I wonder whether Evelyn has some program that automatically capitalizes the first letter of every word or does he do that herself. I actually think it's more annoying than Fort Rock's all caps shouting. Seems like a waste of time. She could make more predictions if she didn't spend so much time pressing Caps Lock on and off.

IF you want to help Art get back on the air, maybe you remind that you were a subscriber and unsubscribed when Art left, but let them know that you would be happy to resubscribe if they had the archive content available or you may want to let them know that you don't understand WHY Sirius would get between you and content you enjoy.  Remind them that the people they are hurting are the fans.  Art doesn't need the money, so if they really care about their reputation as a company, they will graciously step aside and let Art host his own show on the internet. 

Just remember... BE POLITE.  Sending a ranting message is very easy for them to dismiss, but if you are polite and to the point, we will get results.

So you don't agree SXM would have to show damages and prove Art is competing with them as expressed by another of our learned friends? 

So counselor, what about Art announcing he was going on the internet tomorrow to gauge SMX reaction?  Would it surprise you for them to file for an injuction to keep him from doing so if they intended to enforce the NC?  Conversely, if he announced he was going on line and they did nothing, would a reasonable legal mind take that to mean they were not going to enforce?  Would SXM issuing a statement that a NC is in place and that they expect Art to comply be a safe middle ground?
