I appreciate Art keeping us in the loop. I am not sure why he does. It might be manipulative, perhaps a bit of guilt. But I don't know. I think Art is just like everyone else, sometimes he makes a good decision and other times not so much.

He certainly doesn't need to come here and tell us anything. I am quite certain he has financial security. I am sure he can find other ways to keep his "hobby" alive.

When he gets another show I will most likely listen.

Can we do a pay as you go after each show, instead of fronting payment a year in advance?

Fronting payment in advance seems like paying a strange street corner drug dealer for your fix a year in advance, good luck collecting your debt from them.

Jaz, if you think about it it's really only been two weekdays since Art made his latest offer on wednesday? Tomorrow is a holiday, so it's a long weekend. I lived in DC for six years so believe me, that city pretty much shuts down on national holidays. Not always true in other cities, but very little will happen there until at the earliest tuesday. So, I'm not ready to throw in the towel yet. I'm guessing those execs are busy drinking and sucking down oysters in Georgetown or Dupont Circle right about now. Or they're busy with their expensive prostitutes. Either way, they're probably not too concerned about getting back to Art Bell until next week.

I am not crazy about the way some things have been handled, they canned Paul without so much as a Human voice
doing the job and he had been trying to get a handle on the streaming mess every day. Now they take the tactic of simply

Thanks for asking, I am fine. Nothing much to say that I have not already said but good evening!

However I will repeat, people here have no idea the intense talks that were going on from about 3 days
after the show started about the stream drops, I do understand however how it seemed abrupt to the listener.

Also, the deal we tried to make on Wed, two days after the show stopped was a very good one and after saying
they took it very seriously they stopped communicating. I will say again, I think something else is going on.

For those above who listened and did not like the show anyway, it should not even be a issue worth talking about
unless you just like seeing a message from yourself.

It's about when the person is communicating on the board not to directly harass them. It's not about if he did or didn't earn or respect, it's about not making it so unbearably hostile for the poster that they are driven off the board.

Let's consider what a contract is about, it's an agreement the law will enforce. The contract defines what both parties will do to comply and when compliance fails it is called a breech. When one party fails to perform as promised and is in breech the contract will usually define what remedy exists for the injured party. But the clauses and the remedies have to be lawful and reasonable.

From what Art has described, that problems existed from the start, this contract seems compromised by performance and issues of breech by both parties. It is unreasonable to pick select clauses and say I won't comply with this but I will comply with that and still consider the contract as a whole. Under these circumstances it would be very unlikely that any court would enforce the noncompete agreement or interpret it to include a free internet stream from Art's web site.

It's not a matter of honesty or dishonesty relating to the noncompete, it's a matter of what is reasonable. My legal opinion is that enforcement under the described facts would not be reasonable. I think Art would be able to proceed with the show online.

Seriously, reading the most recent posts from Art, this is like any situation where we looking in from the outside have so many solutions, but unless we're in the thick of it, we just don't really get it.  If this was a constant battle from three days in, I can't imagine the level of frustration Art and his Parts were feeling.   I think it's finally sunk into my tiny brain.

Bottom line, at the  moment we don't have Art, and we're hopeful they might just let him wiggle out of the non-compete. 

Lots of us are here waiting for you, Art.  God speed!!

The real problem, primary problem,  this forum has with you, is that you really arent keeping people informed...until the last few hours.

I agree with your central thesis: Sirius emphasises transmission to moving vehicles over  "table top"  reception. That in turn, handicaps listener involvement, which you find essential to a quality program. Further, their streaming player itself  is intrinsically buggy.

And to say -- theres lots going on which you dont know about-- Well , Art, you can tell us something, but you have chosen not to, havent you?
Why?  Dont you think after all this time, we deserve something of an explanation?

If you want the goodwill of this forum, just keep us informed. Its that simple.
