Heather’s website claims copyright in the name of “Midnight in the Desert with Heather Wade.”  There is no such legal entity listed with the Nevada Secretary of State. More foolishness.

As for judgement proof - she owns real property and a lien can be put on it. If Art gave her the property, as some here speculate, the lien could be levied.  If she has a mortgage, the lien is far less valuable, but it could screw up her trying to sell.

Wrong - there is a way to get a license.
You go to the Harry Fox Agency and buy a license. The seller - Heather - has to pay 9.1 cents per song per download.  If there are 10 songs in a podcast and a single subscriber downloads all 20 podcasts in a month, that’s $18.20 per month she will owe Harry Fox for that one subscriber.  She says she’s charging $4.99.  That’s some business model.

Let’s suppose Harry Fox takes a couple of months to find her and she has 200 subscribers. She’ll get a bill for $7,280. That’s worth suing over.
