Depends. If you want to determine the intent of the contract, you might want to depose the guy who wrote it. If you think somebody was DDOSing the site to interfere with Art's streaming, subpoenas to internet service providers may be involved. If you think there is funny business between XP/Sirius and Premiere you could send stacks of Requests for Productions and Requests for Admissions to both parties. You could depose Mr. Noory to see what he knows.

There as many ways to run up the bills as there are attorneys in the room. 

I was JOKING about the DDOS thing.  This suit wouldn't need to go to any of that.  It is a single issue.

The only way they would need to determine intent of the contract is if they are disputing the MEANING of a clause.

This one is simple.  You accept the clause as written and then challenge its validity, stating it is overboard and a restraint of trade.  No evidentiary conflicts, no need for depositions.

The contract is the evidence. It stands on its own.

I thought about it at first and said it would compromise me and leave me open to criticism but I re-thought it and said I would accept only if I could repay him and the proceeds would go to someone else who needs help.

Well that was Saturday. I never got a reply from GN and when he pulled his stuff to take over the DM channel, I discussed it with a few confidants on here and thought it over and said that my sense of honor would be forever stained if I took his money and retracted my acceptance of his offer. I had never asked GN for help nor did I ever expect him to do so, and frankly was astounded that he sent me such an email in the first place.

So... today I told him that after he plunged the knife into Art's back and had said that HE, George Noory, RESPECTED Art, that I could never take his money as he did a despicable thing and that the right thing to do would have been to say NO, I can't do this to Art because it would look bad AND make me look like an opportunist.

Here's what he sent me by way of reply. Note that his " offer " has never been addressed in any subsequent email and that he never replied to my multiple emails. I feel it was a ploy to silence a very visable critic that didn't quite work.

We are merely returning to satellite radio…..in OUR time slot. I wish to God Art was back on there but he quit. What PART of that DON'T  you get ?

And this from a guy who claims to help truckers and wants people to give their money to children in foreign lands and offers to help out a guy who doesn't have much money and then when he takes the offer with a codicil to it, ignores the guy.

It makes it look like you were in the wings like a vampire just waiting to take over Art's channel practically the minute he left.
And I am not the only one who thinks that.

If you were filled with the respect for Art that you CLAIM to have, you would have said NO, I don't want to undermine Art.

That's what I would have done because I have a sense of honor and don't bite the hand that wound up feeding me by turning over a show to you that you dragged into the ground for 10 years.

Furthermore, you complain that people make fun of you on Bellgab.

Hell, even Art commented on how YOU said that a typhoon that hit Vietnam would bring rain to Hawaii, which is dumb.

Speaking of SXM being obsolete in the next 3 years,
I believe even terrestrial radio is in trouble in the next 5-10 years, not just SXM. When every vehicle is equipped with a 'wifi' dashboard people will listen to whatever they want anytime instead of what happens to be broadcasting at that moment. I make a big chunk of my living off of terrestrial radio song royalties but things are changing fast with all this new technology. It takes a while for the technology to spread out to everyone. In music, Dj's are almost a thing of the past, so a niche like Art has will only be growing as the right technology expands to the masses.

I got quite enough grief for  asking for money to get a radio to listen to the best broadcaster on the planet.

Yeah, I could use help but I can't take the criticism right now.
All of this and other things have worn my nerves down to the nub.
I took a big shot of that booze filled eggnog last night and wound up sleeping until noon.
Gotta cut back. I normally don't drink much.

I'll do it on my own and see it through the best I can.
After all the criticism, I'd be stupid to do it again and gunshy as well.

My whole point to the other post is that I couldn't believe that someone with the financial resources of Noory and the supposed feelings for the poor and downtrodden that he has touted for years would be so bold as to make such an offer to someone and then ignore them once he made the offer.

But then, I should have known better given Noory's track record for making things up and his lies over the years.

I really think he did it just to see what I'd do and if I'd accept he'd feel I'd compromise myself as a critic of him.
