Well, that is a question for the attorneys. But there are ways to defeat such a non compete:
1.  Broadcast from overseas or in International waters.
2.  Broadcast for FREE on a show owned by someone else say Richard Hoagland for the next two years.  If I go on the air and interview people and don't get paid I'm not engaging in commerce (and at 75,000 per year if that is what he was really getting from Sirius he essentially was already broadcasting for free anyways).

A non-compete can not deny you making a living. I would imagine that Art's non-compete is only binding on terrestrial or non-terrestrial radio. So, Art would be able to stream his show and would not violate his non-compete agreement.

Good point about being able to stream. That might be possible.

After saying that Sirius had no competition for DM, they have proved me wrong by signing with C2C. In doing so we learned that either they planned on adding C2C as a competitor to DM or they used DM as a bargaining chip to get a better deal with C2C. Either way, I think the NC has little chance of preventing AB from broadcasting. This is the kind of thing that happens when areas of "free enterprise" obtain a monopoly.

From what Noory was saying, it sounds like he believed all along that both would be on Sirius with DM leading from 7-10 and C2C picking up at 10. I wonder if AB knew about that when he signed the contract. If he did, he must have known that he would be at a huge competitive disadvantage with C2C since they had Clear Channel and C2C offered streaming at a much lower price and it had very few dropped signals. I know, I subscribe to it for $55/year and it rarely drops off. With the live drop off rate, AB must have been furious. I know it was real because I experienced it  and not worth listening to let alone paying for it.

If AB didn't know Sirius and C2C planned to have both shows or was told DM would be the only show Sirius carried, then AB should be furious.

On the other hand, maybe AB doesn't care about the competition and just wanted to be on the radio with his audience doing what he wanted to do even if C2C was competing. But again, with the streaming live drop offs, how would that work out if people couldn't hear the program?

 First of all my sincere congrats to Premiere Radio, they made the right move. Business is War
and I would have done the same exact thing, and did in my day.

Second, given the same circumstances I would make the same decision again today about Dark
Matter. There is much you do not know and I will not talk about because it was given in confidence
and I am kind of old school so I will not talk about those things even though it would help you to
understand my decision.

Third, I would love it if Sirius/XM would waive my NC but they said no and even though I could run
out and get a Lawyer and perhaps win back my freedom I will most likely not do that. If I were ten
Years younger it might be a different story, I will say this, It seems crazy as hell to me that we offered
exactly what Premiere ended up taking. Now Sirius/XM has a show that will be mostly commercials and
seems much less a good fit than Dark Matter with a Host who thinks a Typhoon in Vietnam causes rain
in Hawaii. (Last night's show, first hour)

Fourth and finally I would like to say sorry to the people who did come over either by Radio or the less
than stellar streaming, trust me I understand your anger, I only wish you had enough information to
understand my decision.

Money talks.  I called Sirius this morning and told them I would not be subscribing at this time to their service.  I wanted Art Bell available to me to listen.  Also, as a company they are underhanded and unethical.  I will not do business with them, period, at this point.

So that's it then, SiriusXM won't agree to the independent broadcaster idea? I didn't expect them to release you from the non-compete but returning to Dark Matter seemed like it was only a matter of time. Jesus.
