I think Falkie should do a podcast and interview people, take calls. The whole deal. He's great.

I agree. I just want it to be all ready to go for Monday!

I have a feeling that's a very remote possibility if SXM has already released updated schedules. Unless I missed something earlier in the thread.

Here's what I don't understand about the logistics of this whole thing.

If Art gets the stream up and running without the aid of Sirius, then he has limited his audience to those who can stream the show over the net. The audience that migrated to Sirius will be lost as the show will not be streamed to the vehicle audience through mobile radios.

I suppose that folks on the road can listen through a mobile device, but won't that be cost prohibitive? Without the vehicle audience Art is back to the streaming crowd though how many simultaneous listeners could stream is an open question.

Anyway first the argument was too many vehicles with cell phone callers. Now it seems there will be few if any, and an audience that will be limited by the capacity to stream. So wouldn't it have made more sense to stick it out with Sirius who is set to distribute the stream through web app and radio devices? I'm worried that if this does take off it may introduce more difficulties than sticking with Sirius.

I guess my question is, will this option REALLY be better than sticking with Dark Matter on SXM for the next three years and then proposing a move to be an independent broadcaster and exploring the stream then? Seems a bit counter intuitive to me.

We need the Coz mobile bandwidth calculator to gauge nodal costs for the peers to go through the TOR tubes times the market fluctuation of SIM prices for the telco content management... for the stream.  oh and miles per hour.  yes.

I'm raising the bullshit flag.  No legitimate atty is going to make a comment without seeing a contract.  No wonder you are a "former attorney".

He's not offering specific legal advice, he's just merely guessing at the general legal requirements.  You know, the actual damn law.  Something anyone--attorney or no--can look up.

Where to start?

First off The Cure, Mr. Bean, Richard Dawkins and Mel Gibson are not Australian.

The Cure, Mr. Bean and Richard Dawkins are from the UK and Mel Gibson was actually born in the US so you can keep the racist prick.

Crocodile Dundee is generally cringed at by most Aussies for obvious reasons. It is a caricature of what Americans think an Aussie is. Sure there are probably some guys like Mick Dundee in the outback but they are not the norm. Same goes for Steve Irwin. He was closer to Crocodile Dundee than anyone else here.

I've only seen a dingo once and it was in a zoo. They are feral dogs than can't be domesticated so I guess they would eat a baby if they had a chance.

I actually saw my first koala in the wild on the weekend at my in-laws farm. We see many kangaroos there (they are actually pests and the electric fences do a good job of keeping them out). Their farm is about an hour and 20 mins out of Melbourne so we never see those animals in the city and suburban areas.

Vegemite is a staple in every Aussies diet. We have it from the time we can eat solids and it is obviously an acquired taste.

Other than that we are much the same as you guys only tastier.

Please don't tell us there are no topless beaches either ... please?

I've been thinking of doing that but have no idea how.
And don't know how they could call me on my crummy Iphone 4. G*d, I hate the IOS 7 upgrade.
It sucks almost as bad as $noory but not as bad as Art's quitting.
Tell you one thing though. If I had Noory on I wouldn't be as diplomatic as MV was. I'd do my best to hit him with some hard hitting questions and he'd probably hang up because he's already shown he can't take the heat, just like Hogue couldn't.
And sadly, to some extent, Art too, though I still admire and love the guy in a brotherly sort of way.

Alright let me clarify that then, a very small percentage of the base would have picked up a SXM subscription if the stream was given away for free. Much smaller than the number that joined for DM as we know (knew) it.

That's probably true.  I might have even gone that direction not realizing how important the other features would be to me.  As it was, I spent the month before Dark Matter getting rid of my Diet Pepsi addiction (I drank a lot of it) to be able to afford the subscription price.  I got rid of a bad habit, and obtained a very nice product to listen to Art Bell with.  However, that's the only thing I listen to on there, so if he goes, I'll probably go too.  :(

Maybe this was their plan from the beginning to get us hooked on Sirius--That would be okay.  As long as they keep Dark Matter on the schedule!  :o

Is this all you have in your repretoire or do you have some deep seated problem with people who are overweight or who don't meet your personal standards of appearance ?
Or do you just hate nerds and computer types ?
If it weren't for nerd types, you'd still being typing on a Smith Corona or Underwood and there'd be no internet.
And I'm NOT referring to me either, just in general.
A one trick pony becomes tiresome after awhile.

The caller part would be difficult I think. It'd basically consist of you getting a livestream account, opening up your Skype account and recording everything on your desktop with Audacity or something.

Until you figure that out you can have write in questions or something. Like, you can go through the news stories, then comment on some paranormal shit, talk about what you had for dinner, your glasses breaking, shit you heard lately on Noory or whatever. Then go to questions and after that it's peace out! You got shelves of Nostradamus for Chrissake!

In time you can schedule interviews. I don't think live callers are a MUST have. That goes for you, too, art. But it'd be easy to just record the shit and post it on some Podcasting site.

Something like livestream, at least.  There are lots of good hosting services for that sort of thing out there now.  You'd be surprised how many viewers a free account can host, as well.  Anyway, godspeed man.

It doesn't require breach of contract to get out of a non-compete since most are invalid on their face.  I no longer practice law, so I can't give anyone official advice.. HOWEVER, I would certainly suggest that Art have a lawyer really look at the contract.

Here is the basic deal with non-competes.  To make a non-compete binding you need additional consideration BEYOND normal salary. (consideration is the subject of the contract, such as the money paid, service offered, etc.)  Further, it is usually for a narrow and for a specific purpose.  I dealt with this directly several times.  I worked on two "cases" where directors walked off projects and then accepted other projects, despite "non competes".  However, since when they walked off the film, they didn't take any additional compensation, the non competes were non enforceable.  I also did work for a special FX company who hired a high level employee from a different FX company.. that employee was under a STRICT non-compete.. the other company sued and lost, because they didn't have any evidence that the person was using specific trade secrets learned from company 1.  (Obviously I cannot name names).

With that said, the law is slightly different in each state.  But, in general, unless you receive SPECIFIC compensation for the non compete clause, it is not valid.  When Art left premiere, I supposed they gave him a payout and he agreed to a non-compete.  THAT is a valid non-compete.  He received cash in return for the non-compete.  Same thing is with many company purchases.. you get X number of stocks, so long as you agree to a non-compete.

However, here, unless Art took a payout from Sirius, I don't see how a non-compete would be valid.

Again, obviously, he would have to consult his own lawyer and have them look up the specific laws in the venue where the contract is set, but I would be shocked if it would stick.

Very interesting.
Thank you for posting

Not at all Falkie, we're just having a bit of fun at the expense of Coz who was talking down to everyone.

I love nerds, and people of all sizes.

The worst case is that he has a shitty podcast and his only callers are the asshole bell gabbers here who either fawn over him (MEGA PAHRUMPS ART!) or criticize him for every guest he has on.

It's like the twilight zone episode where the Stand Up Commedian who desired fame ended up playing to the same house every night.

Thats not actually an episode, but who the fuck really cares.  You get the idea.

Vaguely lovable becomes vaguely a heavy ball and chain to bear around your neck.

Art must be wireless.....>You must understand this.  His voice doesn't do wires.  They must propagate freely bounce off the ground plane and ionosphere.  But not into the conductive shield of coaxial humdrum.

IF one more heavy breather calls up and says 'MEGA ROSWELLS FROM BELLGAB, ART!' again (more than, you know, the one time that it is acceptable), I'm not going to be responsible for my actions.
