They are pretty standard in every contract, but that doesn't automatically make them enforceable.

Premiere sure had him by the balls with the NC.  Hopefully the Sirius NC will be easier to wiggle out of.  But where would he go?

@Paul, you've been producing from the old XM HQ in Washington, DC, no?  If you're not a SXM employee, would you be located at the source of Art's independent broadcast, i.e. Pahrump?

There are perks there, such as Art's enormous ham radio antenna farm, and possibly direct access to a few LGM's next door at Area 51!

Regardless, I hope this job insecurity thing ends soon.

Actually,  I was producing at my house here in Pahrump.
Evan the board op was mixing in the callers, guests and ads in DC.

As for job security,  Unless you are self employed with a good
customer base, i don't believe there is such a thing any more.

Pretty sure Art worked from his home studio, so I doubt Paul would need to be there.  Michael Savage, for instance, works from several different studios and has a remote staff.

Yeah... I've been holding out on cancelling my subscription.  I've been A) holding a candle of hope that this might blow over and B) weighing whether or not I wanted to keep SXM without Art.

I think Art will be back...I think unless he accepts a financial settlement from sxm, then he can still broadcast with a NC. I think if he is willing to work for free & so is Paul, then that is good news. I'm hoping they will still make some $ in other ways (ad revenue?). We all want Art back, we missed him for 10 years & DM was rolling along & raging into the night. I think Art & Paul care & want a show to come back asap! I remain ever positive...as negative energy gets us all nowhere. Art will be back very soon...from the city of Nye!

Pauls attitude is awesome, but he can only say so much without punctuating his friend's flakiness, I think that's why it's all mums.  This is why I don't think Art or Paul would ever give a live Gabcast interview.  Too much room for bullshit to surface.

 Ok today again we heard nothing from Sirius. It is strange that we get no communication at all.

Just so you know, not any of this was done on the fly, before leaving on Monday I consulted with Paul
and Bob Crane my sponsor and they both agreed it was the right course of action.

On Wed we proposed becoming a Independent Broadcaster, which as with others at Sirius/XM would
have meant we could stream ourself, that was the goal. They said they were activley considering it and
we have not heard from them since. I told them I was willing to be on air the next day.

I wish I had more to report but for now that is it as of the close of business Friday on the East Coast.

It isn't as easy as just flipping a switch. If there is any chance of returning to XM, it's likely in the hands of lawyers. And if any of you've ever dealt with the legal system, such things can take an eternity.

I think art's reached the level of maturity where he can stomach a little criticism, even from friends. The fact is that art is a guy who's ready, willing and able to make life-changing decisions at the drop of a hat. In some ways, its a virtue and in other ways its a self-defeating nightmare, but it seems he's had more wins than losses in his life and though we might disagree with his methodology, we're nevertheless just the audience. And far less successful in his chosen field.

Art, at this point, is regretting his decision I'm sure. Likely what occurred is that the Government default situation, the spider necking, the back-thrown-out-again shit and the Fentanyl patches got him into an emotionally off-kilter state, and he didn't think over his decision as long as he should have. And his relationship with Sirius was still in the courtship phase. In a way, its like he sprung an "open relationship" policy too soon. He should've waited until he was in his mid-40s --- figuratively speaking --- and already in the midst of a healthy swinging population, like what you might find in South Florida. Sirius is a smart girl, though, and she realized that even if they grant his request this time, there's no guarantee that there won't be more requests down the road. Sure, there's advantages to a relationship with art, and the highs can be very high, but Sirius wants someone emotionally stable, committed, and reliable. Like George Noory, but he's spoken for.

I really think you've been kicked to the curb, Art.  No one at Sirius wants to deliver the bad news.  I hope I'm proven wrong, but I don't think I am.

The silence from Sirius may be speaking volumes, Art.  Bottom line, if they wanted to work with you on this, they'd be working with you, right?

So if this doesn't pan out, are there other avenues you can pursue to get back on in some form or another?  Soon??

I like it when Art Bell is in my life.   :)

But if they were considering this, don't you think they'd be in touch w/Art and tell him "hang on -- the legal department is chewing this over" or something like that?  I think they'd keep the lines of communication open if they wanted to pursue this, don't you?
