The moment he signed a contract, and went on the air - the non-compete clause went into effect.

Hypothetically example, without a NC -  Art joins SiriusXM and becomes a huge overnight hit.  He builds a huge new audience, and lots of people are signing up to SiriusXM to listen.  Again hypothetically, he gets a huge offer to return to terrestrial after several weeks... he quits the new position, and takes the new offer.   

All that work promoting and setting Art up for a return is for nothing - and Art collects his new job, using SiriusXM as his launching point.

I'm not saying the current situation is anything close to that - but that is why the NC exists.

Why any company put any dollar into promotion for somebody, if the chance exists for the talent to use them for a short period before splitting away at the first better-looking offer?

I can see how you get to that. Hell I still hold out hope the face on Mars is real. I am not enured to the fantastical, I am just not swept away by it.

Do I think there is a big foot, nope not for a second. But I would be thrilled as hell to be proved wrong. I know Bob Aazar is making shit up... but I like to listen none the less. And I may be challenging on points, but I seldom make fun of others... unless they ask for it.

He was the most entertaining poster here by far, but I'm sure a nightmare for MV to deal with.  If he is gone, it'll certainly change the vibe of this forum.

If you really want to fully understand the pure folly in Art's action,  try writing an explanation to someone who knows nothing of Art, his history, or Dark Matter about what took place.  I did that earlier today in an e-mail to an author in Ireland who I recommended a month ago contact Art's site to be a guest on the show. 

I'll not post the entire exchange, but here is the most telling comment from the author:

"You mean this radio presenter signed a contract to appear on a paid subscriber radio system, then broke that contract six week later when that radio system refused to give away their service at no cost?  The man must be daft."

Pretty much sums it up.

Indiana existed in Sept at least, I attended a football game there.  As for it's current status, I haven't a clue.

Thanks Paul for the info...

Here is the truth of what happened.  Art gave it 7 weeks, and Sirius could not get it together enough for his listeners/callers to be able to reasonably listen.  I think I had the worst connection.   By the way.  I listened last night, and still had it cut out constantly.  So I am sure when you sign a contract, the "other" side has to fulfill their part.  They didn't/can't and Art left.  Case closed.  Art wins!

Dudes, I have been there!  It's real!  I watched Notre Dame getting their collective green and gold asses kicked by USC on a gloomy October Saturday... During halftime, the rain began and the leprechauns came out.  A 17-point deficit slowly disappeared, and with a minute to go, ND took the lead and won.  Best damn sports experience I ever had. 

A father and son were playing catch in front of the stadium before the game.  I asked them to throw me the ball so that I could say I caught a pass at Notre Dame.  ;D
