From what friends have told me about their experiences, those creeps that come in in the middle of the night being all creepy and stuff are what makes it worth it.

My roommate works at a gas station. I was concerned for her the other day when she said her coworker was robbed at gunpoint about an hour after I picked her up from work that day-- and that the panic button is broken.

I always treat people in the service industry kindly. Even the people I have to deal with over the phone-- no matter what issues I have, in most cases it isn't their fault and I don't need to make them hate their job because I can't show them common courtesy or hold my temper.

You wouldn't say that if you'd had to call the cops for beer thefts, fights, trucks catching on fire over the gas resevoir tanks, people yelling at you because their card was over limit and getting robbed by a gun wielding a 44 automag shoved in your stomach.

I never understood it either.

Middle of the night, Art spilling out of a radio, seems like weird folk would lend a lot of charm to that scene.

Not really since it was necessary for the broadcast.

Further, all he would have to do is return the equipment or compensate them.

When I say EXTRA consideration, I am talking about a specific payoff that is for the non-compete clause.

Non compete clauses are a part of almost every major contract for talent and/or special jobs and so are a ton of other provisions that have no real effect because they are invalid on the face.

For example.  You know when you go to a valet and you pay them $3.00 and they take your car and give you a ticket and the ticket says "this contract limits our liability" and it goes onto explain how they are not liable for any damage to the car???  Well... guess what.. they are, no matter what is written on that slip of paper.. even if you sign it.

I have a couple of friends who are doctors and for certain procedures they have the patient sign waivers excusing them from various things, including malpractice, etc...  They were surprised that the patients who sign them the quickest and without even reading them are their lawyer patients.  I explained to them it is because the lawyers know that the waiver is a joke and that if they screw up, they can be sued anyway and the waiver will be tossed out OR it won't matter because the lawyer will burn through all their insurance money just having a fight about whether the waiver should be thrown out.

Again.. I don't know the specifics here.  However, I would be very surprised if a 2 year NC would stand up, unless there is a payment that Art isn't talking about.   (ie, he got a "signing bonus" that he is not returning, etc..)

I don't need to see the contract to make a comment about non-compete clauses in general and why they don't stick.

It doesn't matter HOW you write the contract.  If specific consideration isn't granted for the non-compete, it is very likely invalid. 

In short, if Art was only paid for what he did (ie, his salary for the time he was on the air) and received no signing bonus or end of contract payoff, the non-compete would likely be struck down if it went to court.

I am a "former attorney" because it is a very VERY boring job and the moment I had the opportunity to leave, I seized it.

Hi warsau.

Chances are Sirius is deading the whole deal. According to the schedule found here http://www.siriusxm.com/siriusxmstarstoo/weeklyschedule there are a few replays then its all Jay Thomas. No Art. So, unless art gets out of his noncompete contract, we're looking at another 2 years of silence.

Sorry it's not better news.

The schedule seems to blank out everything from 9-12 cst after DM stops appearing in it.

I was of the opinion that these errors were occurring due to the sheer number of people listening to Art at the one time but given the time that this has happened to you and the fact that this show is a replay makes me think that the errors are as a result of crappy software.
