If you really want to come back, please retain a lawyer and fight this. This clause is unconscionable and unenforceable. Non-competes can not deny you from making a living and this is exactly what this stip is saying.

The non-compete is applicable to the radio industry only. They can not successfully argue that it applies to all communication mediums. Streaming is not radio. Any court, any judge would rule in your favor if you elect to broadcast on the stream only. JUST DO IT ART!!!

This is old and INCORRECT info. These guys are gone. SXM was sold and  recently taken over by new mgt...Liberty Media.

I had the Sirius XM app on my Ipad and did experience some cut outs - not very many though and definitely not a deal breaker to cancel.   However I do remember whenI went to install the SXM streaming app that the reviews looked really bad - I mean it's something like only 2 stars out of 5.  Anyway, I can see how this would be a point of contention for Art in that many listenerse just could not get the show with a poor delivery system (as far as the streaming part).  Still wish we had DM back on the air though.

Possible.  I think I'd be consulting with an attorney before getting too clever, though.  Art's a legendary broadcaster but I don't think I'd want him representing me in a divorce case.

Yes, as I've mentioned, I did some research on Sirius when Art announced his return and Sirius didn't appear to be a bowl of cherries.

Perhaps this has been covered, sorry not going to read through 407 pages.. Couldn't Art Stream oh I don't know say from the Philippines? Does the NC cover international work?

Traditional No Compete clauses cover every form of ""broadcasting""( using the term loosely"") that could be some sort of competition. In short, anything that a SXM potential listener might be able to listen to, no matter where or what the origin, is considered competition. The signer of the contract agrees to NOT compete for 2 years in any way.

The Philippines was also a poor choice since it's an American territory. But I can't imagine
many countries giving a wit for an American contract. If the server is offshore, I just don't see the legal authority.

I think it is pretty safe to assume most people on this board fully support you. In return, when/if you make it back to broadcasting we have the following requests:

1) Call out RCH and ban him on the air. Tell him the data says he is a moron.
2) See if the numbers lady can even do 2nd grade math, and then ban her on the air.
3) Send us all a complimentary signed bottle of Pizza Punch.

That was brought up a dozen or so pages ago. Doubt they could do anything to him there. But he said he wants to fight it or wait it out if need be. I imagine his pirate radio days are well behind him now.

Yep. Looks like John Malone owns them now. He has been dumping a ton of money into them to keep them from going bankrupt. Looks like Howard Stern had to take a pay cut too. They aren't doing well.

Things don't quite add up yet and Art's said there's things he can't reveal.  Understandable in any case such as this.  Who has motive to get Art off of Sirius?  Just more speculation and maybe it's just bad streaming or who knows what.  The bottom line is Art's off the air again.  Damn it.
