Radio and Podcasts / Re: THE RETURN OF ART BELL!
November 13, 2013, 12:28:21 AM
Quote from: FortRock on November 12, 2013, 10:15:38 PMFirst of all my sincere congrats to Premiere Radio, they made the right move. Business is War
and I would have done the same exact thing, and did in my day.

Would someone care to translate this for me? What did they do which he also did in his day? I have no idea what he's referring to.

QuoteIt seems crazy as hell to me that we offered
exactly what Premiere ended up taking. Now Sirius/XM has a show that will be mostly commercials and
seems much less a good fit than Dark Matter with a Host who thinks a Typhoon in Vietnam causes rain
in Hawaii. (Last night's show, first hour)

This too. What did he offer that Premiere ended up taking?

Maybe I missed a new development. Is Sirius/XM putting C2C in the DM spot on that channel or something?

The petition is asking Sirius to "bring back Dark Matter." The petition should be asking Art Bell to do the show again. He quit. Sirius didn't cancel him.

I get the impression Art wouldn't be interested in spending the time to do a show only for the internet. It seems he wants a giant audience listening, by various means (meaning either radio or satellite radio in addition to the web listeners).

A petition is not going to convince a company that sells subscriptions to their programming that it's a good idea to give their product away for free for a year.

Unless they are still paying Art, the contract is void.

That's not how non-compete clauses work. They basically state that if you quit the show you are hired to do, you agree that you cannot legally do a similar show for someone else until the period of time stipulated in the contract expires. It's a way for the employer guarantee that the employee can't just decide to quit one day and then create a competing show for someone else a week later. The employee either fulfills their contractual obligation, or if they decide to quit, they agree to sit on the sidelines until the contract they signed would have expired. The employer doesn't need to keep paying the employee for a non-compete clause to remain in effect. The only way it's no longer in effect is if the employer decides to release the employee from their contract. In this case, Art quit the job he was hired to do. He wasn't fired/released.

There's a non-compete in his Sirius contract, so he can't do anything else until that expires.

Ride, take a free ride,
Take my place
Have my seat
It's for free.

If only it was free, Art...

I worked like a slave for years,
Sweat so hard just to end my fears.
Not to end my life a poor man,
But by now, I know I should have run.

You should have stayed.

I love Art and would listen if he came back. But after so many of us spent money on this it really does feel like he just turned his back on his fanbase.

Basically. It's not like Sirius cancelled him or anything like that. He has a show that he's refusing to do. He's the one who has chosen to not live up to his end of the agreement.

Quote from: Luna on November 05, 2013, 12:44:23 AMI would be sad if I couldn't hear his new show myself.

You can't hear his new show yourself. And make no mistake, it's because Art decided not to do the show he agreed to do tonight. He has air time on Sirius which he has chosen not to use. If he felt an obligation to his audience to do a show, he would be on tonight.

I understand his frustration about a portion of the audience having trouble streaming, but that was not an issue for the entire audience. To expect the company (which he is being paid to produce a show for) to give away their product for free is simply not a reasonable request.

Art took his ball and went home, even though his fans spent money to make it possible for him to play again to begin with. Very disappointing. I love Art's shows, but just refusing to do shows because Sirius won't give them away for free is simply unreasonable. We have no show to listen to because of Art's refusal to do it.
