If this mattered then anything on network television would be free to share.  That is not true.  People get cease and desist orders for sharing TV shows all the time.

The problem with the fair use argument is that Premrad qualifies their programming as entertainment (therefor, in the creative realm, and protected) rather than news/educational (fair use applicable.) Unless you could demonstrate a conscious, resolute and effective effort to use those shows for PURELY educational purposes, and/or that the copyright is illegitimate, you would have no actionable claim, let alone a legitimate claim of fair use.  I am all for freedom of information, believe me, but until there is a worldwide outcry about the more idiotic parts of copyright law in general(probably never gonna happen), that's the rules we must work under, unless you care nothing for legitimacy. I would guess that MV cares for legitimacy( not to mention the lack of lawsuits) hence him taking the necessary action to keep this site online with as little drama and cost as possible.

There are those who obnoxiously quote the constitution and engage deep legal arguments when they're pulled over for a speeding ticket. I've noticed that this isn't a path to power and influence in this society.

Not me. I'm always mindful that the highway cop is underpaid and armed. As an example, when stationed in southern Texas, where sailor types were not well received, getting stopped at night meant the interior dome light was turned on and both hands high on the steering wheel in plain view. For me it is always "yes sir" "no sir" "that's not mine sir".  8)

smart.  i know people who reflexively start bitching at cops whenever they're pulled over.  that never ends well. also, cops in general spend most of their time at work dealing with the diseased rectum of humanity.  that sort of thing really wears on someone. 

I never understood any of that.  I have a problem with the cop or the law, the judge is going to hear about it.  I want that cop to think of me as a friend.

I didn't know you ever had donations to support your efforts-- sorry you had such a disappointing response.  Silent suggested I was wrong to suggest that you fight "my" battle-- rather I was suggesting it was "our" battle and as a paralegal, if you chose to fight it, I would certainly volunteer my services.  I can see why you would choose not to, though. 

CBS just removed Serene Branson's news video which showed her possibly having a stroke and garbling her words.  They used copyright infringement as their vehicle.  I have a sick feeling we are going to see the copyright infringement tool used more widely to remove material people deem other people shouldn't see because it's embarrassing or for whatever personal reason.  Strange because a celebrity moment like this is such a great opportunity for people to learn the F-A-S-T rules for stroke recognition (Face-Arms-Speech-Time).

What was the situation? Are we talking about a bare clip on YouTube?  If the clip were incorporated into a larger work, like an episode of a show dealing with strokes, the authors could claim fair use.  Nevertheless, under the DMCA, first a disputed piece gets removed from the servers, and then the authors are given time to argue their case.

DYTIWA- I found the above clip as the only working one showing the CBS newscaster having a stroke after the Grammies.  On the Washington Post site, other stroke victims commented on the similarity of their experiences with what they saw. Her face is less mobile on one said, commented one doctor.  She was examined afterwards by paramedics but they found nothing wrong and she was sent home.  CBS, caring far more about image and embarrasment, pulled the video off most of the prominent networks and I'm going to hit send so if you are online right now you can see this before it is also yanked.

Googling "Serene Branson video" brought up a ton of hits. Not sure if they will be there tomorrow but it's not at all hard to find right now.

Actually, no need to be a "premium" member. I waded through the source code and compiled a list of direct links.

I personally used a "download manager" to test-download these files (I use JDownloader, but I know you use a Mac, so don't know about availability for you) - but many download managers just download each file one-at-a-time, and wait the appropriate amount of time between downloads automatically.

I am getting speeds of over 1MB/sec, so it literally takes only about 20 or so seconds per file to download.

You're welcome.  There's no rush I don't think.  As long as the files get some use I think the site leaves them alone.  I wouldn't pay for it either unless you wanted to do something more with the site.  As unpopular as the idea is around here you're better off spending $7 a month for streamlink and you could download or stream to your hearts content.

The Administration recommends three legislative changes to give enforcement agencies the tools they need to combat infringement:
1. Clarify that, in appropriate circumstances, infringement by streaming, or by means of other similar new technology, is a felony;
2. Authorize DHS, and its component U.S. Customs and Border Protection (CBP), to share pre-seizure information about, and samples of, products and devices with rightholders to help DHS to determine whether the products are infringing or the devices are circumvention devices; and
3. Give law enforcement authority to seek a wiretap for criminal copyright and trademark offenses.
