From the FBI's statement:

But he was still charged and copped a plea:

Here's one interesting article that attempts to address some of the issues with how Clinton was operating with her personal IT setup.  What was the motivation for Clinton to be operating with a private server to begin with?

If you just need the convenience of being able to operate with portable processor, such as smart phone or laptop, that's done everyday within the Federal government.  In a position such as hers, you're issued a government provided smart phone and a portable processor (laptop, tablet, etc.) and it's SOP to be issued a government email account.  If you're dealing with classified info, you're initially briefed on the importance of using only officially approved procedures and systems for the proper protection of the info.  You are also routinely scheduled for regular briefings on the importance of these procedures and any updates. 

There is no way she and her staff would not be aware that what she was doing wasn't proper, based upon her position and experience.  She wasn't a GS-2 intern clerk.  Remember, this person is running for the highest position within the Federal government.  What is her judgement going to be regarding other things of critical importance?  Others within the government should have stopped this but that does not absolve her of her responsibility in such a high position to never have done what she did, to begin with.  An underling within the State Department could have blown the whistle on her through the IG, for example, but the unwritten discouragement of this is strong, even though, in of itself, illegal.  See the after-the-fact IG report for the assessment of this action.

Comey's action is intriguing.  At best, he basically damned Mrs. Clinton with faint innocence.

I agree.  I am not trying to excuse her, and I suspect that Obama knew exactly why it was 'necessary' and gave tacit approval.  It may not be a coincidence that the day after she was absolved he started a rousing support for her.
