Using it in nearly every damn food commercial or ad for a restaurant to describe food that is in fact not fresh.  Your TV dinner is not filled with fresh ingredients. Or Weight Watchers commercials were they have fresh meals delivered to your door.  Yes, that frozen dinner is "fresh."   ::)

If it's not stale or spoiled, it's fresh, by at least that meaning of the word -- which I use more often than the other one you have in mind.
