The LA Times dig deeper than the other articles.  It was very informative.  When all this came out I wasn't sure the punishment fit the crime, but now I am.

The article above brings up civil suit settlements for sexual abuse and talks about gag orders.  I think gag orders should be illegal in settlements for incest, rape and other sexual offenses because secrecy is how it all starts and goes on.

First of all, during any lawsuit I know of, at least in my area, plaintiffs have "litigation privilege", meaning they are entitled to discuss the claim with "interested parties" (like relatives with young girls who might be taking)  AS LONG AS THE LAWSUIT IS ACTIVE.  Yay!!!!!!!

Victims should take advantage of this. But, a lot of women cower instead, because they don't know the law or what the lawsuit will be like.  But, that is exactly the wrong time to cower, because as soon as the lawsuit is over, "litigation privilege" ends unless special free speech stipulations are written into the settlement papers. 

And, as I understand it, gag orders are often negotiated, which is bad.  But, women should tell their attorneys they want free speech stipulations and no-counter-claim stipulations to protect themselves and their future assets.  Don't be bullied into a gag order.  Or, at least take full advantage of "litigation privilege" first so that later when you are gagged, others will be doing the talking for you by then.  Accepting a gag order in cases of incest, rape,and child abuse is a total cop out which defiles our society and sets up other children to be abused.

Women with good support networks who are financially (surveillance systems, property insurance...) and physically strong enough to rebound from future illegal harassment or retribution should tell the attorneys, no, I won't sign that, and to have their attorney write stipulations into their settlement agreement which endorse the woman's free speech later and also stipulations to prevent the man from counter-suing her. The same with women who may be poor and alone, but are willing to risk the man's wrath (by reporting crimes, obtaining protection orders, etc...)

If a woman can't survive (keep her job, keep her head above water...)  under the perp's potential wrath, then she should have her attorney fight the gag order, or put a time limit on it, but if there is no choice, then sign it.  REALIZING THAT THE CREEP MIGHT NONETHLESS PRESSURE HER TO SIGN A GAG ORDER whether a financial settlement is reached or not.  He might say he will counter-sue her for defamation if she doesn't sign a gag order.  So even if she walks away with no settlement granted, her perp could still silence her if she doesn't talk to her attorney about special free speech and no-counter-suit stipulations.

Usually if the victim insists strongly, good attorneys can convince the guy to drop the gag order and ideas of counter suing.

If a gag order is agreed upon, the victim will have had "litigation privilege" during the whole lawsuit while it was active, free to discuss her allegations with anyone who may need to know (like relatives with little girls).  That civil right is very important, and not exactly advertised, so women should make full use of it before it expires when the settlement or termination of lawsuit is done.

And, also as I understand it, in the end, in typical settlements or ending papers, the judge can't force the offender to pay the settlement any more than the offender can force the victim to really gag herself.  In other words, violations of terms later pretty much just lead to more lawsuits like breach of contract.

After everything is said and done, even if a victim has final stipulations protecting her free speech afterward, the accused nonetheless might still try to threaten to sue her if she speaks out, but even if such a "cease and desist" letter is from a lawyer, I don't think it is really legally enforceable if her attorney had everyone sign off on free speech and no countersuits...

When I read these articles and see how many of the women signed gag orders, I don't understand how bad their lawyers could have been.  The attorney is supposed to represent the client, not represent fear of retaliation themselves.  I can't see any other reason why an attorney would encourage a victim to be gagged.  At that point, I think the civil process looks coercive as well as extorting. And kind of like thinly veiled retroactive prostitution.

I used to keep them in my head.  But in the last few years, password creation has become so complicated, with some sites not allowing certain symbols and other sites only allowing other symbols.  And some sites requiring very long passwords, which screws up my system.

I was trained to use patterns or math so when a person changes, it just progresses.  Yet, it is impossible to pattern, when different sites have different people parameters!

So now I record them too.  But not online...

Wow. Not even a real doctor (not that that would make what he did any better) but a C2C-type "doctor"  who used his practice to abuse so many girls. He deserves his punishment.
