You are confusing the two things. A licensing agreement with a performing rights organization is what gives you the right to rebroadcast it. The point is you can't rebroadcast an illegal copy of a CD or mp3 file.

Ok, thanks, I understand.  But contractural language like this isn't exactly reassuring to the potential "user".  It sounds like the podcaster is on his or her own as far as obtaining the necessary licensing requirements?  Why then bother with a host service?

From Radionomy:
"Users are entirely and exclusively liable for the content of their contribution(s) and the consequences of its being broadcast on the Site.

On this subject, Radionomy Group has the role of a technical intermediary and host only. The users have contractually guaranteed Radionomy Group that they own all the rights and have all necessary authorizations for reproduction and communication to the public on the Site, as concerns copyright, related rights, intellectual property rights, use rights, and in a general way they guarantee Radionomy Group against any third-party action...Radionomy Group does not have the possibility to exercise prior control of all content proposed by users and is notin a position to report infringements of third-party rights. Nevertheless, Radionomy Group expressly reserves the right not to broadcast or to delete from its Site any illegal content, or any content for which it can reasonably suppose, or which it has learned from a visitor or an interested third-party, that it constitutes an infringementof third-party rights, as soon as Radionomy Group becomes aware or has any suspicion of infringement of suchrights, and will do so immediately, without first informing the user who transmitted the content in question and without being required to show proof of the possible illegality or infringement of third-party rights. In the case of deletion of content, Radionomy Group reserves the right to inform any user concerned a posteriori, and to take any appropriate measures to prevent reoccurrence, including the temporary or definitive prohibition to use the Site or all or part of the services proposed. In the event of illegal or prejudicial content,Radionomy Group can take all necessary and adequate measures without notice, including notifying the competent judicial authorities or other control authorities."

...Kinda reminds me of this song from Tower of Power:
"It's not the crime
It's not the thought
It's not the deed
--It's if you get caught"

(*Thanks bateman.  I miss those big horn bands from the 70s!)

There are 6 sites that publish ALL my videos. I don't have a problem with it. It gets me more views.
You Tube somehow lost my first $100 in earnings & I've not had the time to find out how to fix that.
I'm doing the videos for more reasons other than $ as I've said repeatedly.
And Noory told me the interview is still on.
I DO object to the edited videos for a lot of reasons.
Not satisfied with having your own thread, you now spread your inane crap all over the site - and have the temerity to complain when the folks in gen. pop. poke fun at you?  You are the least self-aware person I have ever encountered.

Guys, I have 3 major must have items:

A Worldwide possible listenership by stream
A live FREE stream from 9PM-12AM Mon- Fri
My music

I have a big player who I believe can deliver these things.

If we get all that we will change things, it's looking good.

You are again confusing 2 different things. If Art Bell broadcasts his own show then he owns the rights to it and is fine. If you try to mirror his broadcast or play old Art Bell shows then you will be shut down and held liable should Art decide to go after the station you created. As for the music if you are playing songs from a commercial cd then you are fine because their license with Sabam covers those. If you are playing bootleg live shows as an example then you are liable.

So Radionomy pays all licensing royalty fees for music played on say, Art's show, in exchange for 4 min of inserted ads each hour?  On any song, or just songs for which Radionomy has in their library?

I don't mean to be thick, I think this information is important and much of the disclaimer legalese at these hosting sites obscures important details.

In addition who is responsible for keeping track of which songs are played and reporting that to the appropriate authorities? I admit I'm not sure how the whole licensing of music works but it was implied by Art that there is some kind of recording and reporting process.

Apparently Keith would have to ID3 tag songs on the fly.

No.

I left him alone when he was quarantined to the musings thread.  Now he is wondering around, pissing on the carpets, looking for attention - and then complaining when the attention he gets isn't to his liking.  If he wants to post in the big boy threads, he is going to have to live with the abuse; abuse he has meticulously earned. If he doesn't like it, he can put people on ignore, although I doubt very much he has the technical knowledge to accomplish that task.

Radionomy would stream his show and cover all the licensing fees in exchange for the 4 minutes of ads per hour. That would be on any commercially available song so Art would be covered with all his music. This only covers the streaming. Any on demand or downloadable versions he wants to offer would not be covered.

There is an option to read metadata from file. Depending on which encoder they use there are different options. If the mp3 files contains the proper metadata - artist, title, album - then there would be nothing to do.  All tracks played are logged automatically.

Is there any service that covers licensing for downloadable versions?

When I had streamlink (before I cancelled in 2008) they did not include the music on the downloadable shows. Is this still the case?

Those shows did suffer from not having the music. Having said that it was never a deal breaker. George was the reason I cancelled my account. No music in the world could save him. Not even ABBA!!!!!!1111

I'll let him know if he hasn't seen this already.

Hi once again, funny nobody has even guessed who our big player is but things with them are going very well indeed with respect to all my (3) main requirements and it looks good indeed.

On another subject it truly amazes me that Dave is involved in a fight to what? Shut down all the sights playing MY old shows? I am shocked that he is not chasing the thousands of sites that pilfer his large stock of the best of Dave stuff, oh wait, now I get it.

Since none of my big ideas to solve Art's broadcast problems get any traction on Bellgab...
I'm going back to the source, MR ART BELL.

Listening to Open Lines with Art, broadcast from April 8, 1996. Art was going to begin Boardcasting with a Million Watts on Shortwave
Radio.

Art forget Terrestrial Radio and Internet Streaming crap. We can all buy c crane shortwave radios. No restrictions on bumper music with shortwave!
Yep that's it... I'm brillant... Well OK it was Art's big idea in 1996.

Can you please offer paid subscription Stereo Shortwave?

I have a good guess, but I can't name him. I'm probably wrong anyway. All that matters is you get back on air and are happy with the arrangements.
A good topic for your next shows could be this "Blood Moon" craze. You know, John Hagee claiming the messiah is coming again or the rapture, or whatever.

Thanks for the positive-looking update Art. As for the doofus corporate shill and its censorship mission -- us true fans already have A LOT of your classic shows. Any chance you have any old recordings that aren't "in a collection somewhere" that you could .. cough cough .. send to a trusted someone on the sly for anonymous distribution? I know you don't like your old shows because you think they're outdated .. but they're all I've been listening to for several years now. Soooo - basically what I'm asking is what I've seen wondered by several from this forum -- did you record your shows and do you still have copies of same - for your personal use???  Thanks!
